The image is a common photograph of the film. It has been used and changed many times for years since the movie was out. This image fairly represents the main subject of Abel Gance life, which was Napoleon project. I doubt there is any copyright on it.

It is a low resolution copy of a poster.
It does not limit the copyright owner's rights to sell the film in any way.
Copies could not be used to make illegal copies of the album artwork on another one.
