It is believed that this image is fair use for the following reasons:

• Activision has not released any screenshots into the public domain;
• It serves to illustrate the game in question;
• The image does not limit the copyright owners' rights to distribute the video game in any way;
• The image is being used for informational purposes only;
• Its use is not believed to detract from the original game in any way;
• Its use does not infringe on Atari's ability to sell the game, which is old and hasn't been sold by Atari in decades.
