[edit] Tax protester (United States)

Dear user at IP67.78.35.26: The following verbiage you inserted in the above referenced article was deleted by another editor:

The tax code is unquestionably Constitutional in it's written form, however it is clearly missaplied under color of law as Peter Erick Hendrickson exposes in his book "Cracking the Code". Those who suggest the law doesn't mean what the code and Supreme Courts have established suffer from some form of delusion or confusion. By closely examining the code as it has been legally established most people owe little, if any, by way of the federal income tax. See www.losthorizons.com for more information.

The individual you mention, Peter Eric (not Erick) Hendrickson is an ex-con whose web site, losthorizons.com, is a tax protester web site. He has already served time in prison for at least one tax-related offense, and for conspiracy in connection with placing an incendiary device at a U.S. postal facility that injured two people. Hendrickson's "tax" material is erroneous and frivolous, and his "theory" -- that the full, gross amounts of ordinary wages of an individual are not taxable -- did not even work for him. He filed for, and received, an erroneous tax refund or refunds, and he was later sued by the U.S. government for recovery of the tax refund (or refunds). He lost the case. His case is now on appeal at the United States Court of Appeals for the Sixth Circuit. The Court of Appeals will also rule against him.

Hendrickson is also being investigated by federal law enforcement in connection with his federal tax situation, and he has lost several cases involving attempts to stop various IRS administrative summonses for bank and other records relating to his financial affairs. Hendrickson is neither a lawyer nor a certified public accountant. He is batting zero. Curiously, little if any of this is clearly disclosed on his web site. Hendrickson is just about the last person in the world you should want to be citing as an authority on federal tax law. Famspear (talk) 19:42, 26 February 2008 (UTC)

Oh, and by the way, in one court case, the United States Court of Appeals for the Ninth Circuit specifically stated:

Peter E. Hendrickson appeals pro se from the district court's order denying his petition to quash a summons directed at the EBAY/PayPal fraud investigation team in connection with an investigation into Hendrickson's internet tax evasion business, Lost Horizons.

--Hendrickson v. United States, U.S. Court of Appeals for the Ninth Circuit (submitted Aug. 13, 2007; filed Aug. 22, 2007, under case no. 06-56129) (bolding added).

The Court rejected Hendrickson's attempt to block the IRS summons based on an IRS declaration that the summons "was issued in good faith as part of a legitimate investigation into Hendrickson's tax liabilities and his role in assisting others in evading federal income tax laws." Hendrickson has lost every single attempt to block the IRS from obtaining bank records, etc., in connection with the government's investigation of him, including this case which went all the way to the U.S. Supreme Court, on which the Supreme Court again rejected him just yesterday (Monday, Feb. 25): Peter E. Hendrickson v. United States, No. 2:2006x 50394 (E.D. Mich. June 2, 2006) (petition denied), aff'd, No. 06-1870 (6th Cir., April 10, 2007), reh'g denied, Aug. 8, 2007, cert. denied, No. 07-624 (Jan. 7, 2008), reh'g denied (Feb. 25, 2008).

And look at these:

Peter E. Hendrickson v. United States, No. 3:2006mc00008 (E.D. Va., May 8, 2006) (petition denied; Capital One Bank ordered to comply with summons);
Peter E. Hendrickson v. United States, No. 8:2006cv00345 (D. Neb., Oct. 4, 2006) (petition denied);
Peter E. Hendrickson v. United States, No. 2:2006x 50396 (E.D. Mich. June 29, 2006) (petition denied), aff'd, No. 07-1144 (6th Cir., Oct 2, 2007), reh'g denied (Nov. 30, 2007).

Hendrickson's "losthorizons" followers have also lost every single case. See, for example, United States v. James A. Spitzer, 2007 TNT 163-5, No. 07-11073 (11th Cir., Aug. 21, 2007) (erroneous tax refund of $16,614 ordered to be repaid). Yours, Famspear (talk) 20:27, 26 February 2008 (UTC)
