[edit] Rationale
I believe that this image of J.S. Frelinghuysen can be used in Joseph S. Frelinghuysen without permission of the copyright holder under fair use because:
- It is used for educational purposes on the English-language Wikipedia;
- It is too small to reproduce for commercial use and, as such, does not directly compete with the copyright holder's exclusive right;
- It is used to identify the subject of the article, a notable Republican representative to the state of New Jersey; and
- It would be difficult to produce a free alternative which would provide historical context as Joseph S. Frelinghuysen worked at the beginning of the twentieth century.
