Hello there, I'm here to provide a third opinion ragrding the disputed fair use rationale on this image. I believe the rationale provided is accurate and contains all the information relevant to qualify the image as fair use.

Regarding the image's ability to qualify as fair use (using criteria from WP:FUC):

Regarding the quality of the providing rationale (from Wikipedia:Fair use rationale guideline):

  • What proportion of the copyrighted work is used and to what degree does it compete with the copyright holder's usage? For example, if the image is a photograph or logo, the entire work is likely being used. If the image is a CD album cover, then only a very small portion is being used. A screenshot that reveals the most important discovery of a documentary or the ending of a movie, for example, though a very small portion of the work, may disproportionately compete with the copyright holder's use.
  • The rationale regarding this has been included.
  • If applicable, has the resolution been reduced from the original?
  • The rationale regarding this has been included.
  • To what degree is the image replaceable by a free image?
  • If the image is a screenshot of a movie for an article about the movie, or a corporate logo, there is obviously no such thing as a "free" version of it - all of the resources in the world couldn't produce one. If, on the other hand, the image is a photograph, the image is less irreplaceable, even if Wikipedians may lack the resources to create a replacement.
  • The image cannot be replaced.


The only change I can think to possibly make, is to place the rationale in one of these templates: {{Non-free fair use rationale |Article=Bart Gets Hit by a Car |Description= |Source= |Portion= |Purpose= |Resolution= |Replaceability= |other_information= (optional variable, can be left out) }}
