Diet Coke - trademark or copyright infringement (obviously) the X on helmet is also a trademark from the eXile newspaper. Looks like both eXile and Coke need to give permission - 69.253.195.228

I moved the above comment from the image page to the image discussion page. I don't think the X from eXile is a problem, as the logo is from eXile and would be used under fair use like any other logo. The question, apparently, is does the Coke can in the logo violate anything, as an anon user seems to think it does. --Fxer 02:03, 9 December 2005 (UTC)

The whole image is a logo. It is an interesting question whether a logo which violates copyright may be reproduced under fair use, but I don't imagine it matters, as the role of the Diet Coke can is clearly parody. The logo does not violate copyright by using Diet Coke to sell something, e.g. "If you liked Diet Coke, try the War Nerd!", but instead the logo says, "The War Nerd has a military helmet, but is a Diet-Coke-drinking nerd who never leaves his computer. *snort*" So, it's fair use, because:
  1. The whole image is a logo
    • innately fair use
    • any copyright violation is Coca Cola's problem with the eXile
  2. Usage of "Diet Coke" is a parody
    • in no direct way helps the eXile sell advertising space
    • in no way impinges on Coca Cola's ability to sell Diet Coke
