NCIS are on the case when a Navy SEAL who was convicted of murdering his wife and the cable guy escapes from Fort Leavenworth. Special Agent Todd is stationed to protect the son (staying at his grandparent's house) as there are fears that he may try to contact or harm him. During the night however, the SEAL manages to sneak in and surprise her, tying her up so that he can say goodbye to his son.

McGee, waiting in the car outside frees her and in the ensuing chase, Kate manages to shoot him although he manages to escape with only relatively minor injuries. The NCIS team, suspecting that the SEAL may be in fact innocent, re-opens the murder investigation and brings back the prosecution and defence lawyers involved in the case. While he had not known the identity of the killer before the trial, the team theorise that he had found evidence while in prison. They discover that a few months before he escaped, the SEAL had subpoenaed the phone records of his wife who had made frequent calls to his CO's wife.

The team suspect that the CO, who, due to an injury, returned a month before the husband had been having an affair and had killed her in a jealous rage after finding the cable guy in the house. However, upon discovering that the calls to his house continued while the CO was in hospital but ceased after he returned home, they suspect that the real killer was actually his wife.
