Does this qualify for fair use? The template says that for that it would have to be for critical/commentary purposes, but in this case we're using the picture essentially for the same purpose the original photographer used it... --AceMyth 01:40, 23 July 2006 (UTC)

I agree. This is a misuse of the {{tv-screenshot}} tag, which is why I have just tagged it {{fair use disputed}}. The lack of copyright-free pictures from the conflict is a problem, and because of this perhaps the {{fair use in}} tag could be used instead. But using that rationale we could just as well illustrate the article with good news agency pictures instead of TV screenshots. Thomas Blomberg 17:40, 23 July 2006 (UTC)
You've got to be kidding—just read the entire Fair use rational in the Wiki's copyright notice right on the page: "It is believed that the use of a limited number of web-resolution screenshots … on the English-language Wikipedia … qualifies as fair use under United States copyright law." TV screenshots are Fair use—the only way this wouldn't qualify as fair use would be to populate the article entirely with screenshots from this program. As this is the only one ("limited number"), there is no problem. AdamKesher 17:42, 25 July 2006 (UTC)

Please read the tag and the rationale better. The TV screen shot tag may only be used for identification and critical commentary on the station ID or program and its contents, i.e. you may only use TV screenshots to illustrate articles about the TV stations, programs they run, and possibly also TV personalities working for them. You MAY NOT use TV screen shots to illustrate anything not directly related to a specific TV station. However, as I said above, it is possible you may be able to use the {{fair use in}} instead, which sometimes can be used for unique and important copyrighted news agency pictures. See Image:Beirut.jpg below this one, for instance. If it is felt that the rationale behind using the picture and the tag is valid, it doesn't matter if the picture has been taken by a still camera or a video camera. This image is fair use because it satisfies the criterion "no free equivalent is available or could be created that would adequately give the same information," amongst others. There aren't any Wikipedians in the war zone, so it qualifies. AdamKesher 17:41, 3 August 2006 (UTC)

A mistake I've made myself, so I am sympathetic to your inclination here. But please read the tv-screenshot language (and the discussion above). This template is for fair use commentary on the tv show itself, i.e., "The TV screen shot tag may only be used for identification and critical commentary on the station ID or program and its contents." Therefore, to use it, it must satisfy all of the following fair use criterion:
  • It illustrates the object in question (mass grave at Tyre showing the effect of attacks on civilians)
  • No free equivalent is available or could be created that would adequately give the same information—there are no Wikipedians in the war zone
  • It only is used on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation
