[edit] First Fair Use Criterion
This image's fair use rationale was disputed because it was believed that a non-copyrighted image of this person could be used to adequately portray the same information as the copyrighted image currently being used. There are several reasons why this is not true:
- Any non-copyrighted image of Tim McCord would most likely be taken at a live concert venue where non-professional equipment would create an inadequate image.
- Tim McCord is a member of a popular band, Evanescence, and therefore not readily available to pose for a photograph to be speciffically used on Wikipedia.
- Tim McCord is a new member of the band Evanescence and as such, there are very few free images of this individual that are easilly found online. Any available images would be inadequate to properly portray this individual in an encyclopedic manner.

- I agree that a photo taken at a concert would be adequate, however free licensed images (of the few I have ever seen) are taken by fans and are either grainy or blurry due to the low-light conditions of the concert atmosphere. An acceptable image such as This One would indeed be adequate, however there is no way of knowing if it is licensed or not because it was found on an internet forum.—Gyakusetsu 20:42, 12 March 2007 (UTC)

Deleted. This person makes frequent public appearances. Images of him are clearly replaceable- fair use photos used only to show what the subject looks like violate fair use policy, see counter-example 8. WjBscribe 01:56, 29 March 2007 (UTC)
