Can you confirm that this is a public domain photo? I somehow doubt it...
- It seems to have been released by the family. Why do you doubt it? Also, please sign your posts. SlimVirgin (talk) 17:25, Mar 31, 2005 (UTC)

- Cantus, you didn't answer my question. You wrote: "Somehow I doubt it." Why do you doubt it? SlimVirgin (talk) 18:15, Apr 1, 2005 (UTC)

[edit] AP Photo
This is a family photo but all news outlets I found with the photo are crediting it to AP so they may have purchased the rights to the photo. I don't believe it's PD. --Wgfinley 15:51, 1 Apr 2005 (UTC)
- Just because they're crediting the AP does not mean they bought it. It just means it was a wire photograph. I'd be amazed if any news organization is taking money for this, and I'd say the onus is on you to show that it is, because it's such an unlikely scenario. I've labeled it fair use rather than PD to suit you (it is definitely fair use). I must say I find this fussing about the status of photographs that are everywhere somewhat strange and pointless. Perhaps you could explain? SlimVirgin (talk) 18:14, Apr 1, 2005 (UTC)
[edit] Fair use
I've been asked again about the fair-use status of this. Fair use may be claimed when an item is in the public interest and is being used to educate, not for commercial gain. Furthermore, this photograph was almost certainly released by the family, and is therefore probably public domain: I've labelled it fair use only to be safe. I don't understand why anyone is questioning this. Could someone explain? SlimVirgin (talk) 10:40, Apr 8, 2005 (UTC)
- please clarify the license on the photo description itself :) that's why I brought it up. most people who click through to see the license on the iamage page won'tcome to the talk page for clarification; all you see on the image page is your initial upload comment "PD" and the fair-use template. that's what is confusing... provide as much background as you can on the image page. +sj + 18:30, 8 Apr 2005 (UTC)
