The following is a copy of the email I sent to Mr. Sypolt. I will post any response I get here.

Dear Mr. Sypolt:

I am contacting you from the Wikipedia (http://en.wikipedia.org/wiki/Main_Page). As you may know, we have an article on you at http://en.wikipedia.org/wiki/David_Sypolt. My question is concerning the image we are using to depict you. This image can be viewed at http://en.wikipedia.org/wiki/Image:Sypolt_dave.jpg.

The person who uploaded the image claims that you or your office has released this image under the terms of the GFDL (http://en.wikipedia.org/wiki/GFDL). This is more than a little unusual and I have never heard of another senator releasing the image under this specific license. Can I please get a statement from you as to whether or not this is true?

If this is not the case but if you have released this image, please let me know whether this image has been released to the public domain or if it is available under standard fair-use terms as is generally the case for copyrighted images.

Yes all of the photos of the senators from the state of West Virginia are able to be used as public domain photos.

This implies (though I have not yet confirmed) that the license provided by the original uploader was incorrect. The image was not licensed under the GFDL. However, a public domain license is acceptable to us. --Yamla 17:47, 16 January 2007 (UTC)

Not really, because you have no basis for your statement. Now stop vandalising this photo with bogus not sourced boxes. READ This is Official Press Release Photo from WV Legislature.
Why did I not put in a link to a website where I got it? Because I never got it from a website. And had I done that, then I would be lying. I was in Charleston all last week for the openning of the state legislature, while there I ask state Senator Dave Sypolt a CD with the press release photos of the legislatures for the West Virginia Wiki Project, and he provided them. Call him and ask him where I go them. (304) 698-5299
The source is still Official Press Release Photo from WV Legislature they are released in to the public domain. Call and varify, but do not vandalise this again with your non-sense. You can find Dave's phone number here http://www.legis.state.wv.us/ so that you know I 'm not giving you a bogus one. You will also see the same photo, WOW! because it is the Official Press Release Photo from WV Legislature, but since I got the set from Dave personally putting a link to it would be lying, and I don't lie. --71Demon 21:34, 14 January 2007 (UTC)

The claim is that this image was licensed by the copyright holder under the terms of the GFDL. However, this evidence has not yet been presented to permissions-en AT wikimedia DOT org. See Wikipedia:Requesting copyright permission. --Yamla 03:17, 16 January 2007 (UTC)


Yamla, has repeatedly failed to show any evidence to that this was not released. State Senator Dave Sypolt, has repeatedly stated these photos where released for use. They are not publicity photos of candidates, they are photos of public official --71Demon 16:46, 16 January 2007 (UTC)

You have been repeatedly provided wiht the burden of proof. You even have a phone number of a state senator, that is expecting your call to give you additional proof.
