This image (call number OP-15755) is from the collection of the photographs of the late Otto Perry (b.1894, d.1970) held at the Western History Department of the Denver Public Library (http://photoswest.org/), and is copyrighted. The department actively encourages fair use of its images for educational purposes.

It is believed that the use of these materials

  • for educational purposes, in articles relating to the subject of the photograph,
  • on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation,
  • where the resolution used is insufficient for print use and thus does not materially harm the licensing of these images for publication, and

qualifies as fair use. Any other use of this image, on Wikipedia or elsewhere, may be copyright infringement. See Wikipedia:Fair use for more information.

[edit] Fair-use in EMD SW1

Copyright WikiProject Trains image fair-use rationale: Use of this copyrighted image contributes significantly to the linked article(s) and meets all of Wikipedia's fair-use criteria in that
  • it "identifies the subject of the article(s), and specifically illustrates relevant points or sections within the text;"
  • the image places the subject of the article(s) and/or related items in a historical context as it depicts certain pieces of equipment, structures, people, operations, or events, at a particular location, on a specified date and/or time (equipment and/or structures bear specific paint and/or other identifying decorations);
  • the image has been carefully selected to show various aspects of the subject matter not shown in any other image;
  • the image has a detailed caption that demonstrates its relevance to the article(s); and
  • due the historical context, no free equivalent is available or could be created that would adequately give the same information (the subject of the photograph likely no longer exists in the subject context, and therefore a freely-licensed photograph cannot be taken).
Warning This tag must be used in conjunction with another fair-use image tag. All questions or concerns over the use of this image should be posted at the Wikipedia:WikiProject Trains/Images task force talk page. If an equivalent free image is available it should be uploaded and placed in all relevant articles.
