Copyright undetermined

This work is a copyrighted publicity photograph. It is believed that the use of some such photographs to illustrate:

  • the person(s), product, event, or subject in question
  • where the image is unrepeatable, i.e. a free image could not be created to replace it
  • on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation,

qualifies as fair use under United States copyright law.

Other use of this image, on Wikipedia or elsewhere, might be copyright infringement. See Wikipedia:Fair use and Wikipedia:Publicity photos.

Additionally, the copyright holder may have granted permission for use in works such as Wikipedia. However, if they have, this permission likely does not fall under a free license.

Warning sign

Please note that our policy usually considers fair use images of living people that merely show what they look like to be replaceable by free-licensed images and unsuitable for the project. If this is not the case for this image, a rationale should be provided proving that the image provides information beyond simple identification or showing that this image is difficult to replace by a free-licensed equivalent. Commercial third-party reusers of this image should consider whether their use is in violation of the subject's publicity rights.
To the uploader: This tag should only be used for images of a person, product, or event that is known to have come from a press kit or similar source, for the purpose of reuse by the media. Please add a detailed fair use rationale as described on Wikipedia:Image description page, as well as the source of the image and copyright information. Additionally, if the copyright holder has granted permission, please provide further details as to the terms.

Copyrighted

This image is a faithful digitalization of a unique historic photograph, and the copyright for it is most likely held by the photographer who took the photograph or the agency employing the photographer. It is believed that the use of this photograph

  • to illustrate the event in question where:
  • The photograph depicts a non-reproducible historic event, and no free alternative exists or can be created, and
  • The image is low resolution and of no larger and of no higher quality than is necessary for the illustration of an article, and the use of the image on Wikipedia is not expected to decrease the value of the copyright,
  • on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation,

qualifies as fair use under United States copyright law. Other use of this image, on Wikipedia or elsewhere, may be copyright infringement. See Wikipedia:Fair use for more information.

If this does not accurately describe this image, please remove this tag and provide a different fair use rationale.

To the uploader: please add a detailed fair use rationale for each use, as described on Wikipedia:Image description page, as well as the source of the work and copyright information.

[edit] Rationale

This photograph is used to illustrate an article about a personality. It has low resolution and is therefore acceptable as free-use. Because it is a celebrity, a free picture is difficult to obtain. Finally, the image is being used for informational purposes only.

The image has historical value. A significant part of the article is devoted to her 55-year birthday when she received high awards from both Presidents of Ukraine and Russia (that is quite a feat actually as Putin and Yuschenko hate each other, imagine Bush and Chavez giving say a Mexican pop star high orders of their countries on the star's birthday). The photograph is from that historical birthday. As far as I know it is impossible to become a Hero of Ukraine twice, so the event in unrepeatable.

With the usual difficulties connected to obtaining celebrities photographs he we have that the star leave in a remote and relatively poor country - Moldova. The number of wiki-photographers is much less there then in the USA or Western Europe. Even free photographs of public buildings from there are difficult to obtain. The last is that we have an ailing (she is almost 60 now) pop-singer with ailing health. Today photographs may not represent correctly her image she was trying to create on the scene.

Bearing all this in mind I think we can remove the "replaceable image" tag. Alex Bakharev 07:27, 25 November 2006 (UTC)
