• it is a low resolution still of a film;
• it does not limit the copyright owners rights to sell the film in any way;
• the image was taken by a DVD screen capturer which means this not the original portrait;
• it allows for identification of the characters: newman, kramer;
• it illustrates the film in question and aids commentary on the plot outline.
