Photograph of Ryszard Siwiec self-immolating on 8 September 1968. Image from a newsreel, which captured six seconds of his act.

As a work of propaganda of the communist-era PAP news agency without a specific copyright produced before 1974, the image is public domain under Polish law. Even if it were not, fair use would apply, as this was the only image available of a non-reproducible act (a self-immolation). Furthermore, the image is regularly reprinted in Polish media and government publications without copyright notice; it also appears on the Polish Wikipedia, which does not accept fair-use images.

According to the non-retroactive copyright law of July 10, 1952, of the People's Republic of Poland, all photographs by Polish photographers published before the law was changed on May 23, 1994 that are without a clear copyright notice are assumed to be in the public domain.
This image was uploaded under good faith using the above tag: however, it may be under United States copyright if it was first published on or after January 1, 1923.[1]
