Though the picture is subject to copyright I (Sfufan2005) feel it is covered by the U.S. fair use laws because:

it is a low resolution still of a televison episode;
it does not limit the copyright owners rights to sell the episode in any way;
it illustrates the episode in question and aids commentary on the plot outline.
this image was chosen since Pullo prays for his child and wife's lives as their fates are bleak;
The copyright is most likely held by the studio that produced it, HBO
