The image linked here is claimed to be used under fair use as:

  1. it is a historically significant photo of a famous individual;
  2. Jenrette is notable as the wife of a US congressman, and became notorious after saying that he and she had sex on the Capitol steps in an interview in Playboy; she later appeared on this Playboy cover.
  3. Its inclusion in the article adds significantly to the article because its depiction of the subject of this article was in itself historically significant to the general public.

To reframe the issue within a fair use legal analysis:

  1. The image is the low resolution scan of only the cover of a magazine, and so does not constitute a substantial copy of the original creative work.
  2. The image is used in the transformative context of an informative article about the subject featured on the cover and in the issue, and that article discusses this magazine and its significance for the subject.
  3. The image has no independent commercial value that can compete with the original magazine.
