[edit] Unclear Statement

What is the significance of the statement below? Is the acquittal based on the fact he does not fit the physical description of the attacker, or that Maitua is shorter than the off-duty police officer and thus it could be argued not as strong?

If this is the case, I find it hard to accept that a court would allow this as grounds for a dismissal - I'm 6'6" and 115kg but I highly doubt I'd stand much of a chance against a very fit athelete such as Reni Maitua!

But in December 2004, Maitua appealed both charges and won due to a key factor that the attacker was 6ft 4in (193cm) in height where Maitua stands 5ft 11in (180cm).
