The image linked here is claimed to be used under fair use as:

  1. No free equivalent is available nor could one be accurately created that would adequately give the same information without using unfree satellite imagery as the basis.
  2. The material is not used in a manner that would likely replace the original market role of the original copyrighted media
  3. The amount of copyrighted work will be as little as possible. It is a low-resolution image.
  4. The material was published on Barrick's web site.
  5. The image will be used for informational purposes.
  6. The material meets the media-specific policy requirements.
  7. The material will be used in at least one article, Pascua Lama.
  8. The material contributes significantly to the article by identifying the purportedly controversial boundaries of the proposed pit limits and does not serve a purely decorative purpose.
  9. It will only be used in the article namespace.
  10. This image is a satellite image of the Pascua Lama project area and the proposed boundaries of the pit limits. The coordinates of the center of the image are approximately -29.323146° -70.014142° (29° 19' 23.34" S, 70° 0' 50.9112" W).

Both the author and copyright holder are assumed to be Barrick Gold Corporation.
