Though this image is subject to copyright, I feel its use is covered by the U.S. fair use laws because:

  1. It is a historically significant photo of famous individuals (Louis Dambra, Gary Justin, and John Garner of Sir Lord Baltimore).
  2. It is of much lower resolution than the original (copies made from it will be of very inferior quality).
  3. The photo is only being used for informational purposes.
  4. Its inclusion in the article adds significantly to the article because it shows three subjects of this article.

The reason given is: In my experience, it is impossible to find free pictures of Sir Lord Baltimore. This image was created for an event program for a pair of Black Sabbath/Sir Lord Baltimore concerts that took place at Carnegie Hall on February 19-20, 1971. It shows images of the band's three original members, one of whom, bassist Gary Justin, is no longer with the band. Additionally, it is impossible to create a free image of the band's original lineup, as Justin is also no longer an active musician, making it a near certainty that the three will never perform together again.
