I belive the fair use "publicity photograph" license states: "This work is a copyrighted publicity photograph. It is believed that the use of some such photographs to illustrate: the person(s), product, event, or subject in question in the absence of a free alternative, on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation, qualifies as fair use under United States copyright law." In addition to that I have read that low resolution images qualifies as fair use. Should I write this in the description for the image? Odne A. Oksavik
Wikipedia's main aim is to create free content. Fair Use should only be used where no freely licenced alternative is available. For example this could be of an iconic photograph, a company logo or the cover art of a music CD. For pictures of people, it is quite likely a freely licenced alternative could be made available and therefore it is unlikely FU could be claimed on a copyrighted picture. I notice a lot of your images you have added are in response to the F1 Wikiproject Requested Images - in a lot of these cases the requestors can quite easily obtain a (C) image themselves, what they are looking for is for someone to find or create a freely licenced image. That makes alot of sense in fact. How about if I edit in a comment in the pictures that I have uploaded, and implemented on various F1-related pages, saying that this picture should be replaced with a freely licenced image if someone has one, and I will stop using the 'publicity photograph' license. It just seems difficult to get proper images then..Odne A. Oksavik 14:27, 9 October 2006 (UTC)
The main problem, is that even this isn't permitted by the policy. WP:FU states as an example of an unacceptable Fair Use claim: "8. An image of a living person that merely shows what they look like.". It's something that's violated often throughout Wikipedia, but it's not something that I believe we should do in the F1 articles. By keeping to the guidelines as much as we can, that's how we're going to get good and featured articles. Alexj2002 21:09, 9 October 2006 (UTC)
