See the problems relating to all uses of these images of the Nobel Medal as a logo and as illustrations. See other talk pages pertaining to the Nobel prize medal images. E.g., Image talk:Nobel medal dsc06171.jpg. Currently under administrative review. Clear-cut copyright and trademark violations are in this "Bob Tubbs" claim of copyright? His own photographs of trademarked and copyright-protected illustrations or even photographs of the medals themselves are not his property. The images (that he is photographing) are still the trademarked and copyrighted logo and trademarked and copyrighted images of the Nobel Foundation (and the artists whom it hires to make such works and to duplicate the medals from original artworks, etc.) These images are sold in Nobel Foundation bookshops at the Nobel Museum in Stockholm, Sweden. They are not in the "public domain," and photographs of them cannot be in the "public domain." This purported photographer "Bob Tubbs" does not own the trademarks or the copyrights to these logos and images. He can only make one photograph of them for his own private use (if that); he cannot copy and publish and distribute publicly the images that do not originate with him or belong to him. He is creating a "derivative work" from them without permission, and he has no right to that original work or to distributing derivative works as if he does have such permission or rights. Basically, he is infringing on and violating licensed trademarks and copyrights of others (Nobel Foundation, its artists, et al.). --NYScholar 11:05, 2 September 2006 (UTC)
- The image is included under "fair-use" (see [1], [2], [3]). If this was not possible, the majority of images on wikipedia would have to be deleted, because somewhere within each image is a trademarked or copyrighted object or logo, or a building or vehicle with copyrighted design. The comment of NYScholar seems a bit harsh to me - you seem to be attacking Bob Tubbs or claiming that I have invented him. I uploaded this image - on behalf of the photographer. I and indeed he certainly intended no copyright or trademark violations. If such a violation has occured then an administrator should remove the image - and I am very sorry for any trouble caused. Bob Tubbs has not claimed copyright of this image - merely said that he is happy for anyone to use it. From what you say, this may not be allowed. Therefore, as I say, an administrator should remove it. Please note that the image had been here a long time before your comment. Hjb26 14:37, 5 September 2006 (UTC)
- Please note, NYScholar is wrong. See the archive of his talk page for the discussion. This medal is usable under fair use and the photographer is welcome to release the actual photograph in any manner he wishes. NYScholar has pulled the same thing on other nobel medal pictures as well. Shell babelfish 19:34, 5 September 2006 (UTC)
