The result of the debate was to Delete the image.

There is not a replaceable free image that I could use in the place of this one...

But someone could create one. Our fair use policy forbids using a non-free image if a free image could be created that could be used in its place. See criterion #1 and counter-example #8. In this case, it would be possible to create a free image; therefore this non-free image may not be used. The image is a promotional image of Nicole Scherzinger. There is no free image available that I could locate - or I would have used it - if one exists - FIND IT. This is a correctly tagged and used image and should not be deleted. Ta-ni-ni 21:42, 29 November 2006 (UTC)

As I said below, it doesn't matter whether a free image currently exists or not. So long as one could be made, it is against policy to use a non-free image. – Quadell ^{(talk) (random)} 18:10, 30 November 2006 (UTC)

Hi Ta-ni-ni, I encountered this situation too and asked about it here. Apparently one interpretation of Fair use criteria #1 is, basically, "no non-free image of a living person can be used on Wikipedia, whether promotional or not." Personally I think this could be considered a form of paranoia, but that seems to be the perspective of some administrators. Please visit Wikipedia talk:Fair use if you wish to discuss this.
