The image is belived to be of fair use due to the follwing reasons:

It is an unedited image taken using the free version of Google Earth, thus preserving all copyright tags as required.
It is being used in an educational setting and such is allowed by Google Earth.

At 6th January 2007, Google Earth states that their images can be usd in an educational setting(http://earth.google.com/support/bin/answer.py?answer=42847&topic=1141) Also, that such images may be uploaded to websites as long as they are not used for comercial purposes and preserve all copyright tags. (http://earth.google.com/support/bin/answer.py?answer=21422&topic=1141)
