I don't know what the set time is, if the government does it automatically or if it's at the request of the family. During the Korean War, my paternal grandmother's brother disappeared when his unit was overrun on Nov 10, 1951. After this point he was never seen again by US or Allied forces. It's been assumed that he was captured by the North Koreans. The government declared him dead on Dec 31, 1953, and it's believed that he was buried somewhere in North Korea. Several years ago we were informed that his remains might have been found, but nothing ever came of that.
