[edit] Rationale for fair use in Melbourne Ballpark

Copyrighted

This work is copyrighted and unlicensed. It does not fall into one of the blanket fair use categories listed at Wikipedia:Fair use#Images or Wikipedia:Fair use#Audio_clips. However, it is believed that the use of this work in the article "Melbourne Ballpark":

  • To illustrate the object in question
  • Where no free equivalent is available or could be created that would adequately give the same information
  • On the English-language Wikipedia ([1]), hosted on servers in the United States by the non-profit Wikimedia Foundation ([2]),

qualifies as fair use under United States copyright law. Any other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. See Wikipedia:Fair use and Wikipedia:Copyrights.

To the uploader: this tag is not a sufficient claim of fair use. You must also include the source of the work, all available copyright information, and a detailed fair use rationale.

Copyrighted It should be possible for someone to create or find a freely licensed replacement for this fair use work, and this should be done as soon as is practical. Please request a replacement by adding {{Replacethisimage}} in the image captions or on the talk page of the article(s) where this work is used. Because fair use claims should only be used in cases where adequate free replacements are not possible, this image may be deleted in the future if no effort has been made to replace it with a freely licensed one. Once you have replaced the image, please add {{subst:orfud}} to its description page.

This picture is being used in Wikipedia's article for Melbourne Ballpark, to show the stadium shortly after construction finished.

  • It is of lower quality then the original;
  • It does not limit the copyright owner's rights to sell the related product in any way

Further, i believe the use of the image is fair because it is not being used merely to decorate the related article, but rather:

  • Aids in displaying what the Stadium looked like shortly after its completion, which can not be reproduced as the stadium has now been upgraded multiple times.
