- This is a low resolution image.
- Wikimedia Foundation is registered in the U.S., where copyright law provides for "the fair use of a copyrighted work...for purposes such as...news reporting, teaching (including multiple copies for classroom use), scholarship, or research" (subject to provisions) [1]
- Wikipedia is a non-profit educational/scholarly resource.
- The use of this image on wikipedia will have a negligible effect on "the potential market for or value of the copyrighted work". The image is readily available to the public on the BBC's website. News organisations/publishers wishing to license the image from the copyright holder would request a much higher resolution image from the BBC and would pay for the privilege. The copyright holder, the BBC, is a non-profit entity funded by license fees paid by British television users. It exists for the public good. The BBC website carries no advertising whatsoever.
- The London Bus bombings are becoming an event of political and historical importance. This is a "Unique historical images which we cannot reproduce by other means".
- Due to the difficult conditions on the Underground tubes, photo reportage of the attacks on the underground is relatively poor in contrast with that of the bus bombing. This image relates the destruction caused by the explosions in a way which photo reportage of the tube bombings do not.
- Hundreds of images from the BBC News website are already used on Wikipedia as fair use.

- The existence of other BBC photos does not excuse this one if it's being improperly used. I was under the impression that Wikipedia considered news agency photographs - such as from the AP - as to not have a valid fair use claim unless it was historically significant or of iconic status (like Raising the Flag on Iwo Jima one).
