  • Comments: Concering German copyright law, this picture is in the en:public domain, since, even though it has some originality, it does not clearly surpass average logo design, which is however required for applied art to be copyrighted (to make sure design patent law as lex specialis is not being circumvented this way). This has been decided by German's highest court, BVerfG, 26. Jan 2005 = GRUR 2005, 410 – "Laufendes Auge". The logo may however be protected by en:trademark and/or en:design patent law, as well as the copyright law of other countries.
Fair use rationale
The logo has been part of a court decision concerning copyright, so the picture is essential for discussing how the court ruled. No other picture could fulfil this task, since the lawsuit was just about this special picture.
