Rationale: This is the official Australian Government image of Heydon J. It is almost impossible to get a photo of the judge outside the official photo provided by the Government (this one) as you can't take photos in court. Politicians' photos (in the other branch of government) are available for publicity purposes under fair use - I think High Court judges at least would be possibly available for fair use too.
