Jordaan Michael Clarke underwent successful heart surgery as an infant in 1999 at Oregon Health and Sciences University hospital, but suffered prolonged oxygen deprivation causing permanent and profound brain damage.
After a KATU television (Portland, Oregon) news report by Anna Song, Clarke's riveting story and frustrating journey through the state legal system gained widespread attention.
The Oregon Court of Appeals ruled in 2006 that Clarke's family could seek millions of dollars in damages against OHSU, despite an existing $200,000 limit on jury awards against public entities.
Clarke's case is now the focus of an Oregon Supreme Court case and although the lawsuit concerns a medical case, the ruling applies to all state and local governments in Oregon and could have a sweeping impact on the amount of money government agencies pay out for negligence lawsuits.
