I (--FuriousFreddy) believe use of this image falls under fair use because:

  • It is a historically significant image of a major American musical group, derived from a low-resolution screenshot from a television broadcast
  • The image is of significantly lower resolution so as not to allow any high-quality copies, half the resolution of a standard television broadcast
  • The photo is used for informational purposes only
  • There are no free or public domain images available of the Jackson 5 in concert.
  • The photo is important to the article because it illustrates the subject of the article in a primary method of performance. Being a musical group with a noted live show, it is important to showcase a picture of the Jackson 5 onstage and in concert in the article. --FuriousFreddy 07:38, 21 August 2005 (UTC)
