The basic data for these maps may have come in part from a US Gov't agency, but the maps themselves did not and are not public domain. TCC (talk) (contribs) 04:48, 1 August 2006 (UTC)

I notice the 'image' page specifies that the image is being used under fair use, but its use in Wikipedia articles fails our first fair use criterion in that it illustrates a subject for which a free image could reasonably be found or created. Thanks for uploading Image:Claremont Res 91 Oak Fire.png. I notice the 'image' page specifies that the image is being used under fair use but there is no explanation or rationale as to why its use in Wikipedia articles constitutes fair use. When you use a generic fair use tag such as {{fair use}} or {{fair use in|article name}}, you must also write out on the image description page a specific explanation or rationale for why using this image in each article is consistent with fair use.

Please go to the image description page and edit it to include a fair use rationale.

If you have uploaded other fair use media, consider checking that you have specified the fair use rationale on those pages too. You can find a list of 'image' pages you have edited by clicking on the "my contributions" link (it is located at the very top of any Wikipedia page when you are logged in), and then selecting "Image" from the dropdown box. [edit] Regarding fair use rationale

Sure, I'll help. :) I'm sorry it so long. The image is still there, though. It appears someone else removed the template out of process.

You said on my talk page that The purpose of the screenshot is that it's the only image of that event that exists from 1991, and a very low resolution on top of that. That is an excellent rationale for using this image under fair use. All we need to do is write in broad, sweeping legal-ish terms, and then we're set.

Fair use is detailed in 17 U.S.C. § 107. What is especially important, and what we must establish using a fair use rationale, is that: (the following is from Wikipedia:Fair use#Law)

Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work ... for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright .... the factors to be considered shall include—

  1. the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
  2. the nature of the copyrighted work;
  3. the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
  4. the effect of the use upon the potential market for or value of the copyrighted work.

Less confusingly, these mean that

  1. The use must not attempt to "supersede the objects" of the original but rather be educational or critical.
  2. The less of the original that is used in relation to the whole the more likely that use is fair, though the importance of the specific portion is also considered (as quoting the most important part may attempt to "supersede" the original).
  3. The use must not infringe on the copyright owner's ability to exploit his original work (for instance, by acting as a direct market substitute for the original work), though not through criticism or parody.

Specifically, because (adapted from Wikipedia:Fair use criteria)

  1. No free equivalent is available or could be created that would adequately give the same information
  2. The material is not used in a manner that would likely replace the original market role of the original copyrighted media.
    • It is a significantly reduced screenshot, i.e. it cannot feasibly be reproduced and used commercially.
  3. The amount of copyrighted work used is as little as possible.
    • A low-resolution images is used in the place of high-resolution images, which ensures it cannot feasibly be used for piracy. (Kinda redundant.)
  4. The material was previously published.
  5. The material is encyclopaedic and otherwise meet general Wikipedia content requirements.
  6. The material does the media-specific policy requirements.
  7. The material is used in at least one article.
  8. The material does contribute significantly to the article (e.g. identify the subject of an article, or specifically illustrate relevant points or sections within the text) and does not serve a purely decorative purpose.
  9. It is used only in the article namespace.
  10. The image description page contains:
    • Proper attribution of the source of the material, and attribution of the copyright holder (if it is different) (we don't know).
    • An appropriate fair use tag indicating which Wikipedia policy provision permitting the use is claimed.
    • A clearly understandable and relevant "fair use rationale" for each article for which fair use is claimed. (That's what we're working on. :)

We can work with that. Of course, we'll want to create a shorter, more succinct set of rationales than all the stuff I just posted above. For now, please consider reading all that (I know it is a lot! Sorry =(), developing a set of rationales, posting them here, and then we'll talk. Note: again, I'm terribly sorry I made this post so long, and I'm sorry I didn't reply sooner. I just wanted to give you an update on the status of the image. It is now up for speedy deletion again. The user who removed the template reverted his edits. It may be deleted soon. I totally agree with you, however, that it is a historically significant screenshot that qualifies for educational and encyclopæic use at the article. Once we establish a good set of fair use rationales, I will promptly (or I suggest you should if you want to) list it for deletion review. I just want to clarify that I am not attempting to delete this image out of spite, bad faith, or to disrupt anything; I just want it to be a legally sound claim to fair use and to be used within Wikipedia policy.
