[edit] Fair use rationale

Use of this image in the article on Walter Felsenstein is contended to be fair use. Rationale:

  1. Purpose and character of the use: Educational use: illustrates the article on Il Pigmalione (Donizetti), and Pygmalion (mythology), which should be compatible with a photo distributed in a press kit.
  2. Nature of the copyrighted work: Black-and-white photo, published on the WWW as part of a press kit.
  3. Amount used: Low-resolution thumbnail, suitable for web use, but not for print publication.
  4. Effect of the use on the potential market or value of the image: probably next to none, given that it is a low-res thumbnail of a publicity image.
