Ohio Department of Rehabilitation and Corrections

Qualifies as fair use under Ohio law: State ex rel. Rea v. Ohio Dep't of Educ., 81 Ohio St. 3d 527 July 24, 1998, which stated that state public records may be used for certain purposes without copyright violations. The case on point dealt with whether a private citizen could reproduce state educational competency test information.

(Ohio State University) ... argues that federal copyright laws prohibit the release of the (Ohio Competency Analysis Profile). We reject this argument.... The fair-use exception allows reproduction and copies without infringement of a copyright where the material will be used for purposes such as criticism, research, comment, and for other educational or non profit purposes that are not commercial in nature.
