I found this photo on the cover of sheet music of his song. This sheet music was published in Cuba in 1953 by a company called "Peer y Compañia, S.L." I believe that since the photo is incidental to the purpose of the sheet music (which is sold for the value of the song it contains) that this photo could fall under the category of fair use.
