Since this worker is working on the construction of the Empire State Building, he could not be working on this after 1932. Therefore the photo is in the public domain in the U.S.Quadell (talk) (bounties) 18:00, 29 January 2006 (UTC)

The photo is from 1931 and commonly titled "Icarus", and this site claims copyright "© The Estate of Lewis Hine". Hine published a book entitled "Men at Work" in 1932 [1]; this book contained at least one version of this image (titled "The Sky Boy") according to the George Eastman House.

If the image was first published in 1932, then the image is still copyrighted.
