Yes, but that doesn't make it irreplaceable. So long as it is reasonably possible to photograph the subject and release the photo under a free license, the image is replaceable. Are you saying this would be impossible? – Quadell ^{(talk) (random)} 17:09, 29 November 2006 (UTC)

3. The image as used here presents no potential legal or copyright liability to Wikipedia.
4. It is used to illustrate a biographical article on wikipedia: Derek Sherinian.
5. The image has been published.
6. The image meets general Wikipedia content requirements (encyclopedic).
7. The image meets the media-specific policy requirements (format).
8. The image is used in at least one article.
9. The image contributes significantly to the article in question.
10. The image is only used in the article namespace.
11. The image contains proper attribution of the source of the material, a fair use tag, and a fair use rationale (this one).
