No free equivalent is available or could be created that would adequately give the same information. The subject of the photo is alleged to be the shooter, who was killed by police. All images taken since this person became notable would be post-mortem.
The material must not be used in a manner that would likely replace the original market role of the original copyrighted media. No money was every generated by the copyright holder, through this image.
The amount of copyrighted work used should be as little as possible. This image is not exceptionally high-res.
The material must have previously been published. It was, on vampirefreaks.com
The material must be encyclopedic and otherwise meet general Wikipedia content requirements. It does.
The material must meet the media-specific policy requirements. As done.
The material must be used in at least one article. As done.
