  1. it is a widely published news photograph of a historically significant sports event—one of only 17 perfect games pitched in Major League Baseball history;
  2. it is of much lower resolution than the original (copies made from it will be of very inferior quality);
  3. the photo is only being used for informational purposes;
  4. its inclusion adds significantly to the article because it represents (a) the executor of one of the most recent perfect games, (b) his battery mate, and (c) the rarity and historical significance of the event, as evidenced by the emotional reactions of the two players and the spectators
