The image is claimed to be used under fair use since:
- It is for educational purposes and shows the industrilization of New Jersey and the developments of shipyards in New Jersey
- It is of a much smaller size than of the actual 4.4 MB downloadable version.
- It is a smaller version of one of several images downloadable from the entire website.
- It is marked as free use by the disclaimer, so that there is no market for the image or the rest or the other images on the website. The smaller-sized image doesn't therefore harm the value of the image.
