The photo is of the United States Capitol building, during reconstruction by the United States Army Corps of Engineers in 1861.

It seems likely that PD applies to this photo on several grounds. The photo, taken in 1861, must surely have been published prior to 1923; the author very likely did not live beyond 1906; and there's a good chance that it was taken officially by an Engineer, hence PD-US-gov.
