[edit] Licensing

Copyright undetermined

This work is a copyrighted publicity photograph. It is believed that the use of some such photographs to illustrate:

  • the person(s), product, event, or subject in question
  • where the image is unrepeatable, i.e. a free image could not be created to replace it
  • on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation,

qualifies as fair use under United States copyright law.

Other use of this image, on Wikipedia or elsewhere, might be copyright infringement. See Wikipedia:Fair use and Wikipedia:Publicity photos.

Additionally, the copyright holder may have granted permission for use in works such as Wikipedia. However, if they have, this permission likely does not fall under a free license.

Warning sign

Please note that our policy usually considers fair use images of living people that merely show what they look like to be replaceable by free-licensed images and unsuitable for the project. If this is not the case for this image, a rationale should be provided proving that the image provides information beyond simple identification or showing that this image is difficult to replace by a free-licensed equivalent. Commercial third-party reusers of this image should consider whether their use is in violation of the subject's publicity rights.
To the uploader: This tag should only be used for images of a person, product, or event that is known to have come from a press kit or similar source, for the purpose of reuse by the media. Please add a detailed fair use rationale as described on Wikipedia:Image description page, as well as the source of the image and copyright information. Additionally, if the copyright holder has granted permission, please provide further details as to the terms.

Copyright In addition to (possibly) being usable under fair use, the copyright holder has granted permission for this image to be used in Wikipedia. This permission does not extend to third parties.

[edit] Fair use

This picture's inclusion here is claimed as fair use for the Billy Talent article because:

  • It illustrates the appearance of the band, where there is no other alternative that is more free than this one at this time.
  • This picture can be removed from Wikipedia once free alternatives are found.
  • This image has a photo credit tag.
  • This image's inclusion on Wikipedia does not limit the copyright holder's rights or ability to distribute it, and is based on good faith.
  • The copyright holder, Dustin Rabin, has given specific permission for it's use on Wikipedia after my (the uploader's) request for comment via email (seen below).
  • The copyright holder's only conditions are that the photo credit remains, and the file is no larger than 100 kilobytes. It complies with this as the photo credit can clearly be seen on the image itself, and the file is 45 kilobytes, which is less than half of the maximum.

Hi there.
My name is <name removed>. I am contacting you about on of your pictures of Billy Talent (attached file). I am a contributor on Wikipedia, and any images used on any Wikimedia project must have a licence of some sort (released to the public domain, GNU free licence agreement, copyright to whoever, etc). One of your images was put on the Billy Talent page (http://en.wikipedia.org/wiki/Billy_Talent), and a red flag was put on it because there was no summary on it. I traced it back to you because the photo credit was given in your name at the bottom. It might have come from Billy Talent's official site, but I'm not sure of that. But I did notice it was put on the homepage to your website, along with Taylor Hawkins and David Blaine (http://www.dustinrabin.com/).
But my question to you is, what do you want done? After all, this is YOUR creation. Would you like to release it freely to the public domain, do you want a copyright, or do you even want it on Wikipedia at all? Because I can have it deleted with a few mouse clicks. If you could get back to me on that, that would be great.
Thanks for your time.

<name removed>

P.S. Keep it up, your work is awesome!

Hi, <name removed>. Thanks for writing. How big would it be? The same size as the one you sent to me? If so, it's cool as long as the photo credit remains, and you can make it so when you click on the image it goes to www.dustinrabin.com This particular photo is being used as a press shot for the band right now, so I don't mind it being used on wikipedia, as long as it is 72dpi and under 100KB. Sound good?

Thanks for asking about it!

Dustin
