Although lying about his Republican opponent got Brad elected to Congress, it also got him sued for libel and defamation. The judge found Brad Miller guilty of "negative character assassination" and said Brad's campaign ad "was drafted with the knowledge that it was false and deceptive." The Superior Court summed up the case this way: "While the truth was staring Miller in the face, it appears Miller deliberately elected to cut, paste, and leave out the truth."
