The result of the debate was to Delete the image.
[edit] Replaceable free use tag
The tag placed is to contest your fair use rationale. Basically, Wikipedia fair use policy says that is "a free image might reasonably be found or created that adequately provides the same information" then a fair use image should not be used. In this case, it is probably possible to take a photo of O'Reilly which can then be freely licensed. If you want to contest the issue, the template explains how to do so. As for not harming anyone - if the image is in violation of US copyright law, it could well harm Wikipedia. Also, the aim of the project is to create a free encyclopedia - therefore if possible, images should be under a free license. Hope this helps explain my actions, →Ollie (talk • contribs) 21:35, 16 January 2007 (UTC)
- Go ahead and find a free use alternative then that is of adequate quality. Also, the entire fear of copyrights is overblown and exaggerated. No harm will arise from using this image. It's for an education encyclopedia.Fistful of Questions 21:36, 16 January 2007 (UTC)
- It's not a case of finding a free alternative, its about the possibility of creating one. It's quite possible that creating a free alternative is not possible in the case of a 'celebrity' like O'Reilly, and in that case, you have grounds to appeal against the tag. You should do this as explained, rather than just removing the tag altogether. If you still wish to dispute the tag, add {{Replaceable fair use disputed | Your reason why a free replacement is not available}} to the image page. →Ollie (talk • contribs) 21:44, 16 January 2007 (UTC)
- It's easy to talk in "theory" and "possibilities", but until you can actually act on those theories and provide a free use alternative, the fair should stay, and it is an appropriate fair use.Fistful of Questions 21:45, 16 January 2007 (UTC)
- You are quite correct, and you will find this issue the subject of an ongoing debate. I am not well-informed enough to enter into the issue myself - perhaps you should contact User:Chowbok, who tagged the image as replacable fair use for more information. →Ollie (talk • contribs) 21:50, 16 January 2007 (UTC)
- Actually, Chowbok has a page on the issue in hand: User:Chowbok/Robth's RFU Explanation. →Ollie (talk • contribs) 21:52, 16 January 2007 (UTC)

- Wikipedia's policy here goes above and beyond what is required by copyright law. We are trying to build a freely-distributable encyclopaedia. Therefore we intentionally limit the use of 'fair use' content over and above what is required of us legally: this is why we only allow fair use images where no free use alternative is possible. --ⁿɡ͡b Nick Boalch\talk 23:45, 17 January 2007 (UTC)
