I believe the use of this image falls under fair use as it is a reduced-resolution photograph of a painting. As such, it does not generate copyright of its own, but inherits the copyright of the original painting. Use of a reduced-resolution photo of the painting for purpose of critique of the painter's style and technique falls under fair use.
