I have sent a note to WireImage to confirm the origin and copyright status of this image. Image wire services are not usually well known for releasing celebrity images to the public domain.... -Harmil 18:38, 24 March 2006 (UTC)

The image is not from WireImage per say, from the best of my knowledge it was taken as free use by the charity at that time, the photographer is probibly from WireImage however the actual equipment (i.e. camera,data) is not, thats all I know. In any case I dont think copyright applies. Thanks for your help I am new at this so I'm trying to get it right. Bruce12 18:53, 24 March 2006 (UTC)

A few misconceptions that I think you might have:
  • "free use" is not a term I'm familiar with. If you meant "fair use", then that's a very specific and narrowly defined legal term which must be explained and defended on a case-by-case basis.
  • "I dont think copyright applies" is a dangerous misconception of copyright law. Copyright applies automatically to any work created by anyone in the United States (and most of the developed world). Only an explicit release of a work into the public domain can remove copyright from it.
  • Not knowing the source of an image for sure is the most likely way to have an image removed from Wikipedia.
If you would like to defend the use of this image, I suggested describing exactly how it came to you (URL, name of photographer, watever you have) and explaining the context in which you intended to use it. Others can make the determination of how that does or does not fall under fair use. -Harmil 17:53, 25 March 2006 (UTC)
I went through my files and correspondence on my computer, image was taken on the red carpet by Mike Torchia, personal friend of Austin & Tommy, he frequents these events because of the circles he travels in. Well, then, it's easy. All you need to do is get Mike's permission in writing to release the image under the GFDL, or to the public domain. Once you have that, you can follow the instructions at Wikipedia:Confirmation of permission. Meanwhile I'll change the licensing notice on the image page.
