[edit] Criteria for fair use?

Sorry, I am new to uploading images. This image is copyrighted and the copyright holder is credited, but I am unclear as to whether its use violates fair use criteria. This image was posted by the band on their official website for public viewing. A free image cannot be created to replace it as it is an unrepeatable event. The creator of the image (copyright holder) has not indicated whether or not the image may be freely used or whether its use is restricted in any way, and the original image is not tagged with any licenses or restrictions. Does this qualify as an allowed use of copyrighted material, fair use, or public domain? Seaworldpunk 22:22, 30 November 2006 (UTC)

This image would be considered fair use, and we can only use fair use images if they couldn't be replaced. I tagged this as being "replaceable", but I've changed my mind about that. This image is illustrating a specific event in the past which is talked about in the article, and seems to be an important part of the band's history. —Chowbok 23:03, 30 November 2006 (UTC)
