The Unfair Contract Terms Act 1977 is a British Act of Parliament which regulates contracts by restricting the operation and legality of some contract terms. It extends to nearly all forms of contract and one of its most important functions is limiting the applicability of disclaimers of liability.
The Act renders ineffective any attempt by a business to disclaim liability for negligence leading to death or personal injury. It is also prevents businesses relying on contractual terms which unreasonably exclude or distort their liability to perform their obligations under a contract (typically in the 'small print'), especially where the parties are of dis-similar negotiating power.
