The image linked here is claimed to be used under fair use in the article Jack Abramoff for the following reasons:

  1. The cover is being used in an original encyclopedic article on the life of Jack Abramoff on Wikipedia, The Free Encyclopedia. The cover is being used to illustrate the fact of the publication of the issue in question, which marked a significant event in the revelation of Abramoff's crimes to the American people.
  2. It is a magazine cover, which serves a purpose to induce consumers to purchase the magazine. Interested consumers may purchase access to the magazine in question at TIME's website.
  3. it is of much lower resolution than the original (copies made from it will be of very inferior quality)
  4. It is not intended to lead a reader to believe that the encyclopedic article is endorsed by TIME, and the reader can visit TIME's website to obtain prints of the image or TIME's articles on the subject.
