Copyrighted

This work is copyrighted and unlicensed. It does not fall into one of the blanket fair use categories listed at Wikipedia:Fair use#Images or Wikipedia:Fair use#Audio_clips. However, it is believed that the use of this work in the article "Telford Taylor":

  • To illustrate the object in question
  • Where no free equivalent is available or could be created that would adequately give the same information
  • On the English-language Wikipedia ([2]), hosted on servers in the United States by the non-profit Wikimedia Foundation ([3]),

qualifies as fair use under United States copyright law. Any other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. See Wikipedia:Fair use and Wikipedia:Copyrights.

To the uploader: this tag is not a sufficient claim of fair use. You must also include the source of the work, all available copyright information, and a detailed fair use rationale.

I had sent one of our boilerplate requests for permission (suggesting re-licensing under the GFDL) to Cardozo's webmaster on April 20, 2005, but not gotten any response. I contend it is "fair use" to show this image in the article on Telford Taylor. Lupo 12:55, 15 September 2005 (UTC)

[edit] Fair use rationale

  1. Purpose and character of the use: Educational use: illustrates the article on Telford Taylor, complementing a public domain image from 1946. I considered it informative to show an elder Telford Taylor besides the young man shown in the 1946 image.
  2. Nature of the copyrighted work: B/W frontal head shot. I don't see significat "artistic elements", it's akin to a passport photograph (albeit a little better). Photo has been published previously on the WWW.
  3. Amount used: The image is reproduced in full, but already at the source, the resolution is such that it is unlikely that it could be used for serious print publications.
  4. Effect of the use on the potential market or value of the image: I don't think there is a market for this photograph. See also (3).
